Tarion is a not-for-profit consumer protection organization established by the Ontario government to administer the province’s new home warranty program.

For over 45 years Tarion has served new home buyers and owners by ensuring that one of their life’s biggest investments is protected. Our vision is that all new home buyers in Ontario have peace of mind that they are getting the home they were promised. Our mission is to give Ontario home buyers consumer protection and confidence that their new homes are properly built. We do this through fair issues resolution, education, and outreach. We want homeowners to receive excellent customer service and the best new home warranty program in Canada.

By law, all new homes built in Ontario are provided with a warranty by the builder. Tarion’s role is to ensure that buyers of these homes receive the coverage they are entitled to under their builder’s warranty.
Effective February 1, 2021, Tarion's previous licensing responsibilities have been transitioned to the Home Construction Regulatory Authority. The HCRA is now responsible for regulating new home builders and vendors in the province. To learn more about the HCRA, visit www.hcraontario.ca. 

Understanding Your New Home Warranty and After Sales Service

One - Year Warranty

One Year Warranty Coverage begins on the date of registration.

The One Year Warranty requires that the home be free of:

Defects in workmanship and materials

Defects that cause the building to be unfit for habitation

Ontario Building Code violations

Major structural defects

Unauthorized substitutions

Two - Year Warranty

A builder warrants that, for two years from the date of registration, the common elements are free from:

Water penetration through the basement or foundation walls

Defects in materials or work (including windows, doors and caulking) that result in water penetration into the building envelope

Defects in materials and work in distribution systems.

Defects in materials and work which result in detachment, displacement or deterioration of exterior cladding (such as brickwork, aluminum or vinyl siding)

Violations of Ontario Building Code regulations under which the Building Permit was issued, affecting health and safety, including, but not limited to, fire safety, insulation, air and vapour barriers, ventilation, heating and structural adequacy

Seven - Year Major Structural Warranty

A major structural defect is defined in the Act as any defect in work or materials that results in the failure of a load-bearing part of the home's structure or materially and adversely affects its load-bearing function; or any defect in work or materials that materially and adversely affects the use of the building as a home.

Major Structural Defect (MSD)

The Major Structural Defect warranty covers years 3-7 and includes significant damage due to soil movement, major cracks in basement walls, collapse or serious distortion of joints or roof structure and chemical failure of materials.

In addition to general exclusions such as damage/defect due to condominium corporation action, normal wear and tear, third-party damage, secondary/consequential damage or supplementary warranties/agreements, the MSD warranty specifically excludes dampness not arising from failure of a load-bearing portion of the building; damage to drains or services; and damage to finishes.

What is not covered by the warranty?

  • Defects in materials, design and work supplied by the owner

  • Secondary damage caused by defects under warranty, such as property damage and personal injury

  • Normal wear and tear

  • Normal shrinkage of materials caused by drying after construction

  • Damage caused by dampness or condensation due to failure by the owner to maintain adequate ventilation or proper operation of moisture-producing devices such as humidifiers

  • Damage caused by the owner or visitors

  • Alterations, deletions or additions made by the owner

  • Settling of land around the building or along utility lines, other than beneath the footings of the building

  • Damage resulting from acts of God

  • Contractual warranties which lie outside the Ontario New Home Warranties Plan Act

  • Damage caused by insects or rodents, except where construction does not meet specifications of the Ontario Building Code

  • Damage caused by municipal services or other utilities

  • Surface defects in work and materials specified and accepted in writing by the owner at the date of possession

At the time of your PDI, each homeowner is provided with a new homeowner information package. This package includes home warranty information from Tarion Warranty Corporation, which explains homeowner rights and responsibilities under the Ontario New Home Warranties Plan Act.

Pre - Delivery Inspection (PDI)

Before you take possession of your new home, we conduct a pre-delivery inspection, or PDI.

A PDI is one of your first opportunities to view your completed home. Our Construction Manager will guide you through a comprehensive inspection and can demonstrate how to operate the home’s systems such as the ventilation, plumbing and heating.

Any item that is damaged, incomplete, missing or not operating properly should be noted on the builder’s PDI Form to verify that these conditions existed prior to occupancy. If something has not been installed or completed, this should be noted as well. When the inspection is over, you will be asked to sign the PDI Form. A copy of the CONTACT INFORMATION PACKAGE will be provided as well.

30 Day Service

The PDI provides an opportunity to record your home’s condition before you move in. Any issues should be noted on a PDI Form. The PDI Form does not represent a request for warranty service, so if you fail to note an item it does not necessarily impact your warranty coverage. However, if the problem concerns a damaged or missing item, it may be difficult to establish that this condition existed before you moved in if it is not noted on the PDI Form.

Any items that are not corrected by the time you move in should be listed on the 30 Day Tarion Form. The 30 Day and Year End form represent a request for warranty service and listed items that are covered under warranty must be addressed by your builder within a specific timeframe.

We ask that any items you notice after the 30 day service check point, with the exception of emergency items, be noted and included as part of your year end service request
